Lemko filed a patent lawsuit against Motorola Mobility for stealing unique source code with regards to mobile technology. It claimed that Motorola hired an engineer who was responsible for making the source code and immediately sent the code to its operations in China.
The lawsuit is the latest chapter in the legal battle between the two companies. Motorola said that it hasn’t received the complaint yet and wouldn’t comment on it until its lawyers reviewed the lawsuit.
The source code was about a technology known as position-determining entity. It is used so that the phone can locate its position via satellite signals. With the technology and cellular towers, the phone can easily power services such as Foursquare and Google Maps.
The lawsuit claims that Motorola said that Lemko’s source code was on its servers and tried to cover it up by sending it to its labs in China. Lemko also claims that the source code was used in at least one Motorola handset that was tested on Sprint Nextel network.
The lawsuit could make Google think twice about acquiring Motorola Mobility. Lemko vowed that it would try its best to stop the deal from happening. Motorola has sued Lemko in the past for stealing trade secrets. Motorola claimed that the same employee who was hired away was working secretly for Lemko and supplied it with secrets.
