Judge Rejects Apple Request to ban Samsung Devices in US

Samsung score a small victory against Apple in the United States when a judge denied Apple’s request for a preliminary injunction that would bar Samsung from selling four of its devices in the country. US District Judge Lucy Koh gave a ruling that allows Samsung’s Galaxy S 4G, Droid Charge, Infuse 4G, and Galaxy Tab 10.1 to be sold in the United States. She added that an injunction would benefit other device makers at the expense of Samsung. Samsung Devices

Apple and Samsung have been engaged in a legal battle around the globe. Apple has claimed that Samsung’s devices infringed its design patents and copied the iPad and iPhone. Samsung replied with its own patent lawsuits against Apple. Aside from the United States, the two companies face each other in the courts of Australia, the Netherlands, France, Germany, Italy and more.

Samsung said that Judge Koh’s decision on the preliminary injunction shows that Apple’s case lacks merit. The court recognized that Samsung gave enough evidence to question the validity of Apple’s design patents. The company is confident that Samsung’s mobile devices are different from Apple and this would be shown in court as the case goes to trial in 2012. It would assert its intellectual property rights and defend against the lawsuits filed by Apple.
